Content, intellectual property and acceptable use
Host Content belongs to the Host; Templates belong to Stayloom and may only be used for the Website while the contract is in force. The Host is responsible for the rights to photos and text and for the truthfulness of the information.
Version: IP-v1.0
1. Host Content
- The Host keeps full ownership of the Host Content.
- The Host grants Stayloom a non-exclusive, worldwide, royalty-free licence to store, copy, resize, crop, translate, edit (including with AI) and display the Host Content, solely to provide the Service.
- This licence ends when the contract ends, except for backups still within their deletion period and data that must be kept by law.
- Stayloom uses screenshots of the Website in its showcase only if the Host ticks a separate consent box at checkout. The Host may withdraw at any time; Stayloom removes them within 7 days.
2. The Host's warranties about content
The Host warrants that:
- They have the right to use every photo provided. Photos taken by a photographer need an agreement allowing their use on a website; photos provided or taken by a booking platform may belong to that platform.
- People clearly recognisable in photos have agreed to the use of their image, under Article 32 of the Civil Code 2015.
- They do not copy guest reviews from Airbnb, Booking.com or Google without the right to do so. The Website only shows reviews guests sent directly to the Host and agreed to publish, or a score with a link to the original page.
- Information about rooms, prices, amenities, location and licences is truthful and not misleading.
3. Content written by Stayloom and AI
- Stayloom may use AI tools to write text, translate and suggest layouts. The Host reviews and approves before deployment; after approval, the Host is responsible for the accuracy of the information.
- Stayloom transfers to the Host all rights it has in the text written specifically for the Host's Website. Stayloom does not guarantee that AI-generated content is protected by copyright.
4. Templates and source code
- Templates, source code, the website building system, the dashboard and the Stayloom brand belong to Stayloom or its licensors.
- The Host has a non-exclusive, non-transferable right to use the Template for their Website while the contract is in force.
- The Host may not copy, resell or extract the Template for use on another website, or reverse engineer the source code.
- The same Template may be used for other customers with different content.
- Third-party fonts, icons and libraries are used under their own licences.
4.6. Template use after buying the Exit Package. When the Host buys the Exit Package (Article 14A of Part B), the right in section 4.2 becomes perpetual, non-exclusive, non-transferable, and limited to one website on the Host's domain presenting the accommodation named in the contract. The Host may change the content, photos and colours. The Host may not use the Template for another website, resell it, share it or add it to any template library. If the Host sells the accommodation, this right passes with the website.
5. Prohibited content
The Website must not contain or be used for:
- Content that breaks the law of Vietnam or of the place where the Host operates, including content prohibited by cybersecurity and advertising law.
- Sexual services, gambling, controlled substances, weapons, or regulated business the Host is not licensed for.
- Fraud, impersonating accommodation, or taking booking payments for accommodation that does not exist or that the Host has no right to rent out.
- Fake reviews, fake prices, or promotions that do not exist.
- Discrimination against guests based on ethnicity, religion, gender, nationality or disability.
- Content infringing other people's copyright, trademarks, image or privacy.
- Malware, phishing pages, or unlawful data collection.
6. Notice and takedown
- Anyone who believes the Website infringes their rights may send a notice to stayloom.net@gmail.com, stating the content, the link, the basis of their right and their contact details.
- Stayloom forwards the notice to the Host. Clearly infringing content, or content a competent authority requires, is removed or hidden within 24 hours.
- The Host may respond with evidence. Stayloom restores the content if the evidence is reasonable and the complainant does not file a lawsuit within 10 working days.
- A Host who repeatedly infringes may have the contract terminated under Article 14 of Part B.
